1. About these terms
“We”, “us” and “our” means Restaurant Essentials. “You” means the business or person placing the order. By placing an order you agree to these terms, our Delivery Information, Returns & Refunds, Warranty and Privacy Policy pages.
Our products are commercial equipment and supplies intended for business use.
2. Orders
- An order is a request to buy. It is accepted when we confirm it by email or when we dispatch the goods.
- We may decline or cancel an order, for example if a product is no longer available, a price or description on the website is clearly wrong, or we cannot verify the payment. If we cancel, we refund any money you have paid for the cancelled goods.
- Stock levels shown on the website are a guide only. If an item is delayed or out of stock, we will contact you with options, including a full refund.
- You can cancel an order free of charge before it is dispatched. After dispatch, our Returns & Refunds terms apply.
3. Prices and payment
- All prices are in Australian dollars and include 10% GST unless shown otherwise. You can switch the website to show prices excluding GST.
- Delivery charges are shown on each product page and at checkout and are added to your order total.
- We accept payment by credit or debit card, PayPal and Afterpay through secure third-party payment providers. We do not store your full card details.
- Goods are dispatched once payment has been received in full. A tax invoice is emailed with your order confirmation.
- Prices can change without notice. The price you pay is the price shown when your order is placed.
4. Delivery and collection
- We deliver to addresses in Australia. Delivery options, prices and estimated times are set out on our Delivery Information page.
- Delivery times are estimates. We are not responsible for delays caused by carriers, weather or other events outside our control, but we will keep you updated.
- You must make sure someone is available to receive the goods and that the site can be safely accessed. If a delivery fails because the premises are closed, the address is wrong or the goods cannot be unloaded, redelivery costs may be charged.
- For Click & Collect orders, please wait for our confirmation that the order is ready before collecting.
5. Risk and ownership
- Responsibility for loss or damage passes to you when the goods are delivered or collected.
- Ownership of the goods passes to you when we have received full payment.
6. Checking your goods
Please check your order when it arrives and before you sign for it. Tell us about any damage, missing items or wrong items within 2 business days of delivery by emailing sales@restaurantessentials.com.au with photos. Do not install or use goods that arrived damaged.
7. Installation and use
- Many products must be installed by a licensed tradesperson, for example gas appliances and equipment that needs hard-wired, 3-phase or 15 amp power. You are responsible for arranging and paying for installation.
- Please follow the manufacturer’s instructions for installation, use, cleaning and maintenance. Incorrect installation or use can affect the manufacturer’s warranty.
- Product information, specifications and images are supplied by manufacturers. We take care to keep them accurate, but please check that a product suits your space, power and gas supply before ordering. Contact us if you are unsure.
8. Returns, faults and warranty
Returns are handled under our Returns & Refunds policy and faults under our Warranty policy.
9. Your rights under Australian Consumer Law
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or changes any right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded.
10. Limitation of liability
To the extent permitted by law, we are not liable for indirect or consequential loss, including loss of profit, loss of trade, food spoilage or business interruption. Where the law allows us to limit our liability, our liability for goods is limited to, at our choice, replacing or repairing the goods, or paying the cost of replacing or repairing them.
11. Privacy
We handle your personal information in line with our Privacy Policy.
12. Website content
The content on this website, including text, images and design, is owned by us or our suppliers and may not be copied without permission. Links to other websites are provided for convenience only.
13. Changes to these terms
We may update these terms from time to time. The version on the website when you place your order applies to that order.
14. Governing law
These terms are governed by the laws of Australia and the state or territory in which Restaurant Essentials operates.
